There are thousands of people affected by "red-tags" in Santa Cruz County, CA. In the case County of Santa Cruz v. Carrick, the 6th District Court of Appeals found that the County was not authorized to record a notice of violation against landowner, Paul Carrick, in absence of a statute or court order permitting the recordation. This announcement was sent to Santa Cruz County readers and also includes information on water controls and ICLEI's involvement in Smart Meters. Santa Cruz Property Owners Beat County on Red Tag Issues

County of Santa Cruz v. Carrick:  In a 4/18/11 decision, the Sixth District Appellate Court found the County of Santa Cruz unlawful in its recordation of red tags for alleged building code violations.

In the case County of Santa Cruz v. Carrick, the 6th District Court of Appeals found that the County was not authorized to record a notice of violation against landowner, Paul Carrick, in absence of a statute or court order permitting the recordation.

Associate Justice Wendy Clark Duffy of the 6th District Court of Appeal has directed the County to expunge the red tag recordation against Carrick.

There are literally thousands of other residents with illegal filings by Santa Cruz County but Judge Duffy is refusing to publish the decision. Unpublished decisions cannot be cited as case law in future cases, but this is still a good advance for other abused property owners. Here is a copy of the unpublished decision.

Elan and Reverend Oracle v. County of Santa Cruz Planning Department; Tom Burns; Santa Cruz County; Ellen Pirie; Jan Beautz; Neal Coonerty; Tony Campos and Mark W. Stone:

In February 2011, the County of Santa Cruz, CA paid $750,000 to Elan and Reverend Oracle in a settlement for the Planning Department's issuance of a red tag (notice of violation). The bogus red-tag battle ensued over a hedge!

This case has exposed a disgusting display of arrogance by the County Planning Department and County Supervisors, not only for harassing the homeowners but also for wasting a million dollars of taxpayer money on settlement and legal fees.

Despite being informed, The Santa Cruz Sentinel did not publish this news, but thankfully The Mid County Post reported the full story here:  http://www.mcpost.com/article.php?id=3294.

The Water Police are Here!

Soquel Creek Water District is not unusual in their desire to issue fines and even jail for normal activities... Pay close attention to what your water district is up to. Read it in their own words here: Soquel Creek Water District literature (highlights are ours).

ICLEI and PG&E Partner for Smart Meters

Researchers will be interested to see this document that proves ICLEI (Local Governments for Sustainability, aka the International Council for Local Environmental Initiatives) works withPG&E to monitor, control and potentially harm our bodies through the use of Smart Meters. Use the search engine and you will see ICLEI mentioned about 12 times in the PG&E document at this link: http://www.pge.com/nots/rates/tariffs/tm2/pdf/GAS_3082-G.pdf
